Terms of use

NearbyON is run by YCARUS CAPITAL LLC ("NearbyON", "we", "us"). These terms explain the rules for using nearbyon.app. By using the site, you agree to them. We wrote them in plain language on purpose: if something isn't clear, write to us.

What NearbyON is

NearbyON helps people find independent local pros and talk to them directly, by WhatsApp or phone. We are a directory. We don't do the work, we don't employ the pros, and we're not part of any agreement between a customer and a pro. Prices, schedules, payments, warranties and the work itself are agreed between the two of them.

For customers

  • Using NearbyON is free for customers.
  • We don't confirm everything a pro writes on their page. Before you hire, check the license when the job needs one, ask for proof of insurance, get the job in writing and pay in stages. Our guides explain how.
  • Be honest in your requests, and use the pros' contact details only to talk about your job.

For pros

  • You must be at least 18 to make a page, and it has to be about you or a business you are allowed to represent.
  • Keep your page true and up to date: your name, trade, area, contact details and license.
  • If your trade needs a license where you work, you must hold it. If the law asks you to show your license number in your ads, as Florida does for contractors, put it on your page.
  • Post only photos of your own work that you took or have the right to use, and nothing illegal, misleading, violent, hateful or sexual.
  • Don't use NearbyON to send spam or to collect people's details for anything other than their job.

Your photos and texts

What you post stays yours. You give us permission, free of charge and without exclusivity, to show it, resize it and share it to run and promote NearbyON, for example on your page, in search results and when people share your link. When you delete a photo, we stop showing it; copies may stay in our backups for a while.

Signing in

You sign in with a one-time code sent to your phone or e-mail. Keep it to yourself: NearbyON will never ask you for it. You're responsible for what happens on your page when you're signed in.

Reports and removals

Anyone can report a pro page. When several different people report the same page, it goes offline automatically until the pro reviews it. We may also hide or remove pages, photos or texts that break these terms or the law, and block people who abuse the site.

Fees

NearbyON is free for customers, and making a pro page is free. If we add paid extras one day, they will be optional, and we'll show the price before anyone is charged.

No guarantees

We work hard to keep NearbyON useful and online, but we offer it "as is". We don't guarantee the work, prices, availability, licenses or insurance of any pro, or that the site will always be available or free of errors.

Our liability

As far as the law allows, NearbyON is not liable for indirect damages or for losses that come from the work or the behavior of a pro or a customer, and our total liability to you is limited to US$100. Nothing in these terms takes away rights that the law gives you and that can't be waived.

If you break the rules

If you break these terms or the law and someone makes a claim against NearbyON because of it, you agree to cover the costs that come from it, as far as the law allows.

Changes

We may change these terms. We'll update the date at the top, and if a change is important we'll let you know on the site or by e-mail. If you keep using NearbyON after a change, you accept the new terms.

Law

These terms are governed by the laws of the State of Florida and the federal laws of the United States.
